Accepted Uses and Content Policy

Web Hosting Services
The policies and guidelines expressed herein supplement the rights and
obligations of the parties under the Service Agreement of even date. This
document establishes operating principles and acceptable use policies as they
relate to the Customer's use of the Internet and the connection/services
provided by PiXEL WebWare to the Customer under the Service Contract Agreement.
This service provides web hosting to thousands of clients worldwide, and we
have a responsibility to protect each client and provide the best services
available. The following guidelines were designed to insure these services.
General
The Internet is a voluntary association of
users interested in and willing to exchange information and data with other
Internet users. At present there is no oversight group providing governance over
the principles, policies or procedures for use of the Internet or the
information and data accessed via the Internet.
In order to facilitate their contractual relationship the Customer and
PiXEL WebWare wish to define a working protocol of principles and
policies and establish operating guidelines and acceptable standards of
use of the Internet.
To this end the parties agree as follows:
Principles Governing Acceptable use of the Internet by the
Customer
Responsibility and Respect - The Internet is a
network intended for use by mature, adult users. The Customer recognizes this
principle and undertakes at all times to act with respect, courtesy and
responsibility, giving due regard to the interests and rights of other Internet
user groups. This general guideline carries with it the following specific
responsibilities:
- Knowledge of the Internet - The Customer agrees to obtain a basic knowledge
of the Internet and its operating principles and procedures.
- Improper Uses - The Customer will avoid violation of certain generally
accepted guidelines on Internet usage such as restrictions on mass mailings and
mass advertisements, pirating or copying of software, mail bombing or other
methods of attempting to deny service or access to other users, and attempts to
violate security.
- Compliance with Laws - The Customer will ensure that its use of the Internet
complies with all applicable federal, state and local law and regulation,
including but not limited to those principles of law which protect against
compromise of copyrights, trade secrets, proprietary information and other
intellectual property rights, libel or defamation of character, invasion of
privacy, tortious interference, and export of technical or military data to
prohibited countries.
- Validation of Information - The Customer is responsible for validating the
integrity of the information and data it receives or transmits over the
Internet.
- Security - The Customer is required to protect the security of its Internet
account and usage. The Customer's password will be treated as private and
confidential and not disclosed to or shared with any third parties.
- Discretion and Judgment - The Customer is expected to use discretion in the
treatment and handling of Internet information and data and to take particular
care to insure that adult information is not transmitted to juvenile users of
the Internet.
- Pornography - Due to legal and social issues, we will not accept customers
who publish pornographic images. If an existing customer publishes pornographic
images, PiXEL WebWare may issue a warning and/or suspend your account. If account is
suspended due to porn violations .. there will be no refunds of fees paid.
- Excessive CPU usage - Customers will not be allowed to use excessive amounts
of CPU processing on any of our servers or face immediate suspension.
For example:
- 1) A few customers have tried re-selling our counters or
auto-responders to the rest of the world without prior approval which caused an
excessive amount of requests on our servers.
- 2) email bombs.
- 3) re-selling CGI access to other 3rd parties
- 4) IRC Bots these bots can create hostility among other net
users which result in spamming and mail bombs.
- Suspension - Activity which results in your account being suspended will
result in loss of fees paid. No refunds will be made. Damages caused by your
account will result in financial loss to you. Any complaints arising as a result
of your client activity will be obvious grounds for suspension.
- Refusal of Service - We reserve the right to refuse or terminate service to
anyone for any reason.
Content
All services provided by PiXEL WebWare may be used
for lawful purposes only.
Transmission, storage, or presentation of any information, data or material
in violation of the Indian Constitution, State or City law is prohibited. This
includes, but is not limited to:
- Copyrighted material, material we judge to be threatening or obscene, or
material protected by trade secrete and other statue.
The subscriber agrees to indemnify and hold harmless PiXEL WebWare from any claims
resulting from the use of the service which damages the subscriber or any other
party.
Note: Pornography and sex-related merchandising are prohibited on any
PiXEL WebWare server. This includes sites that may infer sexual
content, or Link to adult content elsewhere. This is also true for
sites that promote any illegal activity or content that may be damaging
to PiXEL WebWare servers or any other server on the internet. Links to
such materials are also prohibited.
Examples of non-acceptable content or links
- pirated software
- Hackers programs or archives
- Warez Sites
PiXEL WebWare will be the sole arbiter as to what constitutes a violation
of this provision.
Unlimited Traffic
We are pleased to offer our clients
unlimited Web page traffic, to maintain the integrity of our service the
following limitations apply.
- Sites housing multiple directories with unrelated information
- Sites with more than one main page.
- Multiple hosts resolving at a ip or domain name we provide
- Sites with Banners, graphics or cgi's running from their domain being used
on other domains.
- Sites with graphic archives or galleries
- Sites offering download archives, such as .zip, .tar, .ra and .GZ.
- Sites using more than 20% of system resources
If you do not qualify for unlimited, traffic will go unmonitored until you
reach 1 gig, then normal data transfer costs of Rs. 250/100megs will apply.
PiXEL WebWare will be the sole arbiter as to what constitutes a violation of this
provision.
Chat Rooms
We do not allow clients to install their
own chat rooms. These tend to be large system hogs and we cannot allow it as a
account option. We do provide a choice of Java chatrooms for a small extra
charge that will more than fill your needs and run without hindering the
performance of the machine for others.
Background running programs
We may allow programs to
run continually in the background, these are considered on a one to one basis
and a extra charge may be incurred based on system resources used and
operational maintenance needed.
IRC
We currently do not allow IRC or IRC bots to be
operated on our servers.
Commercial Advertising - Email
Spamming, or the
sending of unsolicited email, from a PiXEL WebWare server or using an email address
or URL that is maintained on a PiXEL WebWare machine is STRICTLY prohibited.
PiXEL WebWare will be the sole arbiter as to what constitutes a violation of this
provision.
Server Abuse
Any attempts to undermine or cause harm
to a PiXEL WebWare server or customer of PiXEL WebWare is strictly prohibited.
Any Sub-Networks of PiXEL WebWare and dedicated servers must adhere to the above
policies.
If any terms or conditions are failed to be followed it will result in
grounds for account deactivation.
